Rapid Rack warrants to Buyer that the Products it manufactures shall be free from defects in materials and workmanship for a period of twenty (20) years from the date of first purchase (“Limited Warranty Period”) when installed properly and used for the purpose for which it is designed (the “General Limited Warranty”). Products with an anodized finish shall have a five 

(5) year finish warranty, warranting from the date of first purchase until five (5) years thereafter (the “Limited Finish Warranty Period”) that the finish shall be free from cracking, chalking or visible peeling under normal atmospheric conditions (the “Limited Finish Warranty”). The Limited Finish Warranty does not apply to any residues deposited on the finish.

The General Limited Warranty and the Limited Finish Warranty (collectively, the “Limited Warranty”) does not cover damage to any Product that occurs during its shipment or storage (unless caused by Rapid Rack) or installation. This Limited Warranty does not cover (i) Products that have been altered, modified or repaired without written authorization from Rapid Rack or its authorized representatives, (ii) Products used in a manner or for a purpose other than that specified by Rapid Rack, (iii) damage or malfunction caused by ordinary wear and tear, (iv) damage or malfunction caused by a failure to properly operate or maintain the Product in accordance with written instructions provided by Rapid Rack, or (v) damage or malfunction caused by Buyer or third party abuse, accident, alteration, negligence, vandalism, or Force Majeure. Transportation and incidental costs associated with this Limited Warranty are not reimbursable. 

If within the Limited Warranty Period or Limited Finish Warranty Period, respectively, a Product defect is discovered that is covered under the General Limited Warranty or the Limited Finish Warranty, respectively, then Rapid Rack shall either repair or replace, at Rapid Rack’s election, the defective Product or a defective component thereof. Such repair or replacement shall completely satisfy and discharge all of Seller’s liability with respect to such defective Product. Rapid Rack must be notified of Limited Warranty claims, in writing, within thirty (30) days after the discovery of the defect, otherwise, such warranty claim shall be waived. Further, should Rapid Rack be notified of a Limited Warranty claim, (a) Rapid Rack shall have access to the alleged defective work, and to the operating records, maintenance records, and other information that Rapid Rack reasonably deems necessary to verify the validity of the claim, and 

(b) Rapid Rack shall be given unhindered access to the work and the required utilities for purposes of performing the required warranty work.
